अमेरिका में एक पंद्रह वर्षीय लड़का था जो एक दुकान से चोरी करते पकड़ा गया था। पकड़े जाने पर, गार्ड से छूटने की कोशिश करते हुए दुकान का एक शेल्फ भी टूट गया।

न्यायाधीश ने मामला सुना और लड़के से पूछा,
"क्या तुमने सच में ब्रेड और चीज़ का पैकेट चुराया?"

लड़के ने नज़र झुका ली और कहा — "हाँ।"

न्यायाधीश: "क्यों?"
लड़का: "मुझे उसकी ज़रूरत थी।"
न्यायाधीश: "तुम्हें वह खरीदना चाहिए था।"
लड़का: "मेरे पास पैसे नहीं थे।"
न्यायाधीश: "तुम अपने परिवार से मांग सकते थे।"
लड़का: "घर में सिर्फ मेरी माँ हैं। वह बीमार और बेरोज़गार हैं। मैंने यह चोरी उन्हीं के लिए की।"
न्यायाधीश: "क्या तुम कोई काम नहीं करते?"
लड़का: "मैं कार धोने का काम करता था, लेकिन माँ की देखभाल के लिए एक दिन की छुट्टी ली, तो मुझे निकाल दिया गया।"
न्यायाधीश: "क्या तुमने किसी से मदद मांगी?"
लड़का: "मैं सुबह से घर से निकला था, लगभग पचास लोगों से मदद मांगी, लेकिन किसी ने नहीं की — तब मैंने यह कदम उठाया।"

पूछताछ के बाद न्यायाधीश ने निर्णय सुनाया —
"चोरी, विशेष रूप से ब्रेड की चोरी, बहुत शर्मनाक अपराध है। लेकिन इस अपराध के लिए केवल यह लड़का नहीं, हम सब ज़िम्मेदार हैं।

इसलिए अदालत में मौजूद हर व्यक्ति — मेरे सहित — दोषी है। यहाँ मौजूद हर व्यक्ति पर दस डॉलर का जुर्माना लगाया जाता है। कोई भी व्यक्ति तब तक अदालत से बाहर नहीं जाएगा जब तक वह जुर्माना नहीं भर देता।"

यह कहकर न्यायाधीश ने खुद अपने जेब से दस डॉलर निकाले और रखे। फिर लिखा —
"इसके अलावा, एक भूखे बच्चे के प्रति अमानवीय व्यवहार के लिए मैं दुकान पर एक हज़ार डॉलर का जुर्माना लगाता हूँ। अगर 24 घंटे के भीतर यह राशि जमा नहीं की गई तो दुकान को सील कर दिया जाएगा।"

अदालत ने आदेश दिया कि पूरा जुर्माना उस लड़के को दिया जाए और दुकान उससे माफ़ी मांगे।

निर्णय सुनते ही अदालत में मौजूद सभी की आँखें नम हो गईं। वह लड़का भी रोने लगा। वह बार-बार न्यायाधीश को देख रहा था, जो खुद अपने आँसू छिपाते हुए अदालत से बाहर चले गए।

क्या हमारा समाज और हमारी अदालतें ऐसे फैसलों के लिए तैयार हैं?

चाणक्य ने कहा था —
"यदि कोई भूखा व्यक्ति रोटी चुराते पकड़ा जाए, तो उस देश के लोगों को शर्म आनी चाहिए।"

In America, a fifteen-year-old boy was caught stealing from a shop. While trying to escape the guard, he accidentally broke one of the shelves.

The judge listened to the case and asked the boy,
“Did you really steal a packet of bread and cheese?”

The boy looked down and said, “Yes.”

Judge: “Why?”
Boy: “Because I needed it.”
Judge: “You should have bought it.”
Boy: “I had no money.”
Judge: “You could have asked your family.”
Boy: “I live only with my mother. She’s sick and unemployed. I stole it for her.”
Judge: “Don’t you work?”
Boy: “I used to wash cars, but I took one day off to care for my mother, and they fired me.”
Judge: “Did you ask anyone for help?”
Boy: “I left home in the morning, asked around fifty people for help, but no one responded. In the end, I did this.”

After hearing everything, the judge began his verdict:
“Stealing — especially bread — is a shameful act. But this crime is not only the boy’s fault; it is ours too.

Every person present in this courtroom — including myself — is guilty. Therefore, I fine everyone here ten dollars. No one will leave without paying.”

He took ten dollars from his own pocket and placed it aside. Then he wrote,
“In addition, I fine the store one thousand dollars for showing inhumanity toward a hungry child. If not paid within 24 hours, the store will be sealed.”

The court ordered that the total fine be given to the boy, and the store must apologize to him.

As the verdict was read, tears filled everyone’s eyes — even the boy began to cry. He kept looking at the judge, who quietly left the courtroom, hiding his own tears.

Are our society and courts ready for such judgments?

Chanakya once said:

“If a hungry man is caught stealing bread, the shame belongs to the society, not the man.”
